In a recent case Tom issued a claim for a client against their former employer and was informed that the trial would take place in December 2027 (over two years from now!). Not only is it an astonishing amount of time for a claimant to wait to find out if their claim is successful but it highlights the strain the justice system is currently under.
Speaking to Tom earlier today he said :
“When I saw the tribunal hearing date I couldn’t believe it, I really felt for the client because he deserved better from his employer when he was employed and now the justice system is also letting him down with this massive delay. In those two years my client would have moved on with his life and I am certain that he does not want something like this hanging over him”
Rather than go through the rigmarole of the employment tribunal Tom frequently advises clients on the time-saving benefits of using settlement agreements to quickly bring employment disputes to an end. In most cases an employee will agree to leave their post voluntarily on the proviso that they receive a payout of money (usually tax free). In most cases Tom can see clients in a matter of days and employment contracts can be terminated by consent with minimal fuss.
