Navigating Neighbour Disputes: What are your rights to address these issues?

During our lives many of us will encounter challenges with our neighbours and this could be either at home or at our business premises. When issues first arise often individuals are well advised to have a quiet word with their neighbour but what happens when those challenges escalate and become unmanageable? By their very nature in this type of dispute the individuals concerned will live in a close proximity which can heighten the stress and anxiety that this type of dispute can generate. Sometimes matters cannot be resolved amicably and if a dispute persists a frequently heard phrase when matters escalate are ‘you will be hearing from my solicitor!’.

At Moss Solicitors, we understand the complexities of neighbour disputes and are here to guide you through your rights and options when faced with property-related conflicts. I have advised on neighbour disputes for the past ten years and have advised upon the following types of dispute that we can assist you with:

Boundary Disputes : When a neighbour has replaced a fence and moved the boundary, typically in their favour. This type of dispute usually arises if the work is carried out when the client is not at home (at work or on holiday).

Tree and Hedge Disputes : a neighbour either cuts down trees or hedges (or both) on your property without your consent.

Shared driveways:  In cases where a neighbour is obstructing a right of way over a driveway or misusing their driveway.

Noise Nuisance and other types of nuisance : The type of nuisance caused can ruin your enjoyment of your property and infringe upon your rights. Typical noise complaints include the barking of dogs, loud parties, or heated arguments. I have advised on other types of nuisance including nuisance smells emanating from a neighbour’s property.

Property Damage and Trespass: This dispute can arise where a neighbour either purposefully or negligently damages your property or accesses your land without your consent.

CCTV Use: Disputes may arise over the use and field of view of surveillance cameras.
