Thinking of popping the question this Christmas?
Christmas is a magical time for proposals, with many couples choosing the festive season to take the next step together. But alongside choosing the perfect ring and planning the big day, there is another conversation worth having before you say “I do” – whether a prenuptial agreement could be right for you.
Often referred to as a pre-nup, a prenuptial agreement allows couples to discuss how their finances might be dealt with if their marriage were ever to break down. While it may not seem the most romantic subject, it can offer valuable peace of mind for the future.
A pre-nup can be particularly important if one partner has significantly greater wealth than the other, perhaps through property, savings, investments or a business. It can also help protect family wealth or a future inheritance. For couples bringing children from previous relationships into a new marriage, an agreement may help clarify their intentions for assets they wish to preserve for their children’s future.
The key is to approach the conversation openly and honestly. Discussing finances, expectations and existing commitments before marriage is not a sign of mistrust; it is an opportunity to understand each other’s circumstances and make informed decisions together. Transparency is essential, with both partners fully disclosing their financial position so that any agreement is fair and properly considered.
Without an agreement, your spouse can make a claim on all of your assets whether in joint or your sole name, even if it is a pre/post marriage asset. The court will consider the circumstances and what is fair, which can leave both parties facing uncertainty.
In England and Wales, pre-nuptial agreements are not automatically legally binding, but the court will give them significant weight if appropriate safeguards are met and certain procedures are followed. Both parties should obtain independent legal advice, make full financial disclosure and enter into the agreement freely, with sufficient time to consider it before the wedding.
At Moss Solicitors, our family law team can advise you on whether a pre-nuptial agreement is appropriate for your circumstances and help you put arrangements in place that reflect your wishes. We offer a free 30 minute appointment to discuss your needs.
So, if you’re planning to pop the question this Christmas, remember that a little forward planning now could provide reassurance for the years ahead – leaving you free to concentrate on building your future together.
